Is there a Need to Revise Codes of Research Ethics in view of the CRPD?

The main purpose of ethics regulation of human subjects research has always been to provide protection to research subjects. Certain groups, such as persons whose capacity to consent to research is impaired, have been viewed as vulnerable to exploitation and harm, and therefore in need of particular safeguards. Persons who cannot provide free and informed consent may only be enrolled in research projects if certain criteria are met. These are, roughly: the project has the
potential to directly benefit the research subject; research of comparable effectiveness cannot be carried out on individuals capable of giving consent; and authorization has been given by a suitable third party (a legal representative or an authority). Recently, these safeguards have been criticised for being over-protective, hindering important research from being conducted and violating human rights law, such as the Convention on the Rights of Persons with Disabilities (CRPD) – a convention which grants persons with disabilities wide-ranging rights to autonomy and participation in society. This presentation discusses the specific norm-conflicts between the CRPD and codes of research ethics, such as the Additional Protocol to the Oviedo Convention concerning
Biomedical Research, Declaration of Helsinki and the CIOMS guidelines.
